Flash Media Encoder 2 (FME) has just been released. FME is a FREE live broadcasting tool and designed to enable you to capture live audio and video while streaming it in real-time to Flash Media Server (FMS).
It uses the high quality VP6 codec (and chances are that H.264 will be added to support the Flash Player's upcoming new codec) and also adds MP3 audio encoding, a much requested feature. On top of that, FME can also be tightly integrated into your streaming infrastructure with command-line control both locally and through a remote connection. Auto-restart after power failures or other system re-starts helps ensure that your live streams are reliably available.

Licensee shall not use the MP3 compressed audio within the Software for real time broadcasting (terrestrial, satellite, cable or other media), or broadcasting via Internet or other networks, such as but not limited to intranets, etc., or in pay-audio or audio on demand applications to any non-PC device (i.e., mobile phones or set-top boxes). Licensee acknowledges that use of the Software for non-PC devices, as described herein, may require the payment of licensing royalties or other amounts to third parties who may hold intellectual property rights related to the MP3 technology and that Adobe has not paid any royalties or other amounts on account of third party intellectual property rights for such use. If Licensee requires an MP3 decoder for such non-PC use, Licensee is responsible for obtaining the necessary MP3 technology license.
there are some encoding tools out there where the rights are not clear for us,, the users.
another example is the on2 flix engine. this libs uses patent protected codecs without having license for it. the lib use mp3 lame and memcoder and some parts of ffmpeg code. i think its very lame to sell it for thousends of dollars to adobe & co.
we had the same problem with mp3. we fight thru all patent licensee and figure out that you must sign an agreement with mp3thomson.com if you want use the mp3 codec for broadcasting / streaming.
you can be for sure that the patent owner are watching the net :) example was youTube. today google pays millons of dollars for the license.
i only can say that you all read excatly the license that the manufactors were shipping with their products. and ask a lawyer if you want start a business modell with the tools.

Your own experience with the legalities of using MP3Pro or MP3Surround is the result of these not being free tools. Why not use MEncoder? Is there something about it that makes it inferior?
